A plea in the Supreme Court of India was filed by Dr. Subhash Vijayran (Advocate) for the inquest of guides or manuals in plain English and vernacular easily and effectively interpreted language by common people describing the law and the process for the vindication of rights and redressal of grievances under the law.
The petition is the result of the complexities faced by common people. The petition argues that the common man does not grasp the procedure or the law. The way the legislation is implemented, followed and applied in our country infringes on the human rights of the masses by refusing them access to justice. Everything mentioned in the laws is way too complex and confuses the common man. The laws compel public institutions to use plain words to make access to programs and facilities in many countries.
The PIL insists that the government shall have a guide in simple and vernacular English on general laws of public concern, describing the legislation and its applicability in easy-to-read words. Moreover, the whole set of rules and regulations, notice, notifications, and other provisions provided by all legislative branches-of a general public interest-of rules and regulations, notices, notifications, must be in plain language. The appellant has also argued that the level of appeals applied to the Supreme Court is necessary to be of the highest quality.
Lawyers need to make special attempts to make their pleadings simple, crisp, and coherent, and correct. So much of the scarce time, attention, and money, both of the Court's lawyers and lawyers/litigants, have been lost due to badly-written and effusive drafts and oral arguments, the plea said.
The plea asked the Bar Council of India also to implement in 3 years and 5 years LL.B. a required theme of "Legal writing in plain English".
