The Allahabad High Court dissolved an appeal filed by the husband to suppress the FIR under Section 307 of the Indian Penal Code (Attempt to murder) for injuring his wife by choking her neck. The two-judge bench of Justice Pankaj Naqvi and Justice Sanjay Kumar Pachori communicated it’s grief over filing the petition. They said that the Court was working under compelling conditions wherein both the Bar and the Bench are putting their lives at stake. They described the petition as a “sheer abuse of the process of the Court”.
The petition was dismissed with the cost of Rs.10,000/- which shall be gathered by the Collector, Bulandshahar as an income for land, from the petitioner, Dharmendra, within one month from the date of releasing the order.
The bureau has been asked to do the required duties. An obedience report has been instructed to be submitted by the Collector to the Records office of the Allahabad High Court within 2 months.
On account of the COVID-19 pandemic, a nationwide lockdown was forced on March 25, 2020. Quickly, the Supreme Court, the High Courts, and the Subordinate Courts had to switch to virtual hearings. All across the country, the courts at different levels have limited themselves to the hearing of pressing and critical subjects only.
Recently the Allahabad High Court had repudiated the decision to an advocate for hearing via video conferencing, citing "high risk" of COVID-19 contagion. The Bench of Justice Vivek Agarwal told the Additional Solicitors General of India Mr. Sanjay Kumar Om that his appeal for a virtual hearing cannot be granted since the Computer Section of the High Court comes under the "high-risk zone" for COVID-19 contagion and hence no one from there can be permitted within the Courtroom.
