The Allahabad High Court questioned how it is possible for a fair price shop dealer to change the Aadhaar number which is exclusively accessible to the National Informatics Centre, i.e., the NIC.
The single-judge Bench of Justice Manoj Kumar Gupta requested the Principal Secretary of the Food & Civil Supply of the Uttar Pradesh Government to file a private affidavit and describe how an individual could control the data maintained by a Central Government consultant.
The Court was hearing the petition filed by Awadhesh Kumar, a fair price shop dealer, whose license was cancelled by the District Magistrate, on the basis of incorporating in the database of the recipients.
It was claimed that Awadhesh Kumar changed the Aadhaar card numbers of the individuals through an anonymous technical operator, by creating mechanisms and then using the bio-metric of others who are not the real recipients, and the necessary supplies were distributed.
The order is major as it raises an important question of the data privacy of an individual. The Petitioner opposed that the accusations against him are based on speculations and is not theoretically possible. The accusations are vague since it is not specified in the order that with whose conspiracy the manipulation had taken place.
It was noted that the login ID and password are generated by the NIC, Lucknow and that the E-Pose machine cannot be altered by fair price shop dealers. It is not conceivable for a fair price shop dealer to change both and that in no situation it is possible for him to change the Aadhaar number fed in the E-Pose machine through the NIC Central Server.
