The bill which grants the National Commission for Backward classes statutory powers was unanimously passed by the Rajya Sabha. This constitution Bill was moved for discussion by social justice and empowerment minister, Thawar Chand Gehlot in the Rajya sabha wherein it was passed unanimously with 145 votes in favour. It was also passed in Lok sabha on 2nd August. The constitutional status to NCBC will be granted after the approval from half of the states and further the president’s assent.
After this amendment, Article 338-B will be inserted in the constitution which will read as, “There shall be a commission for the socially and educationally backward classes to be known as the National Commission for Backward classes“.
Gehlot promised that the requirement made by opposition for a women member in the commission will be fulfilled while making the rules. He also said that,” NCBC will have no right to interfere in the functioning of such state bodies. This law will not be binding on the state backward commissions and the latter will continue to enjoy the powers vested in them.” He further said that, “We have proved that we were, we are and we will be in favour of reservations”. He emphasised that BJP strongly backs the rights of Dalits, tribals and backwards.
However, there were various criticisms from the Congress members. One of the members made an allegation that BJP is a party that mainly favours upper castes and opposes the reservation policy.
