The Chief Justice of India, Dipak Mishra has introduced a subject-wise roster system, a much needed system in a country like India and 7th of August was the day it came into effect due to the appointment of three new judges namely Indira Banerjee, Vineet Saran and KM Joseph. The new notification by the chief justice did not change the subjects that were assigned to the other judges of the Supreme Court.
The new roster assigned the following categories of matters to Justice R. Banumathi: labour matters, Rent Act matters, service matters, compensation matters, criminal matters, family law matters, ordinary civil matters, simple money matters and mortgage matters etc.
In a press conference that was held in January by the four senior-most judges of the Supreme Court, in it the judges declared that the administration of the Court was “not in order” and that many uncalled for things had been happening over the past few months. The primary concern of the senior judges was the assignment of the matters to the judges and they believe that the Apex Court must be guarded from basis for the assignment of the matters.
The views of the judges were soon supported by the Campaign for Judicial Accountability and Reforms. They asserted that such are examples of “abuse of power of the master of roster”. They created a petition for the same.
Finally, the Court dismissed the petition by saying “CJI was an institution in himself” and therefore declaring that the CJI need not consult the collegiums on the said matter.
