Amidst Discomforting controversy ignited by the interference by the Central Government on the appointment of Judges, newly appointed Supreme Court Judge, Justice K M Joseph had some mildly pleasant words to say about his promotion.
At a function hosted by the Supreme Court Bar Association in order to comment and congratulate the three newly appointed Judges, Justice Joseph amusingly stated how he felt like an infant due to his promotion to such a monumental institution. He added that he would do his utmost to abide by the oath he took as a Judge, and be true to the Court. Without making any gigantic promises, he pledged to give it all for the justice system of our country.
What is concerning is that despite being the senior-most among his peers, and after being recommended by the voting college consisting of the CJI among other SC Judges, Justice Joseph was still denied of his seniority as he was placed below his peers, Justices Indira Banerjee and Vineet Saran.
Extraneous intervention by the Central Government in the form of a notification resulted in depreciation of the seniority of Justice Joseph. There is considerable unease in the Supreme Court arising out of this uncalled for action by the government, with questions emerging about the power the executive has over Courts. These concerns were forwarded to the CJI, Dipak Misra by fellow Judges AK Sikri and MB Lokur. It was decided that the issue would be scrutinized post the appointment of the new Judges. Needless to say, this is an over exaggeration of power by the Central Government that is not only unnecessary, but also deteriorating to the very principles of the separation of instruments of the Government.
