The State Government of Uttar Pradesh filed a transfer petition in the Supreme Court of India seeking a transfer of all the cases challenging the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Ordinance, 2020 (hereinafter referred to as the UP Ordinance) that are currently pending in the Allahabad High Court to the apex court of the country. The Bench, comprising of Chief Justice of India SA Bobde, Justice A.S. Bopanna, and Justice V. Ramasubramanian, of the Supreme Court of India, heard the transfer petition on Monday 25th January 2021.
The UP Ordinance was passed by the Uttar Pradesh State Cabinet in November and had received the assent of the State Governor Anandiben Patel on 28th November 2020. It seeks to regulate marriage between people following different religions and any religious conversions that may be a part of such union.
Due to the controversial nature of the UP Ordinance, it has been challenged by multiple people in the Allahabad High Court. This resulted in the Allahabad High Court issuing notice to the State Government on 18th December 2020. During the hearing, the State Government had conveyed to the Court their intention to transfer the petitions to the Supreme Court of India. Since then, the petitions are pending in the Allahabad High Court.
After hearing the plea put forth by the State Government of Uttar Pradesh, the Supreme Court of India stated that it would like to reserve its views on this matter to itself for the time being and would like to see what the Allahabad High Court has to say on this matter before taking a stance in this matter.
On hearing the views of the Court, the State Government asked the Supreme Court of India to allow them to withdraw their transfer petition and the same was allowed by the apex court of the country.
