On 3rd June 2021, the Delhi High Court granted interim bail to an inmate, who was tested positive for COVID-19 and also lost her eyes to Black Fungus inside the jail premise. A single-judge bench of Justice Mukta Gupta heard the petition filed by the petitioner name by Meenu, who was arrested facing for the commission of criminal offences under Sections 420/409/506/120-B/34 IPC had sought interim bail till the next date of hearing.
As the medical report of Central Jail, Tihar suggested that Meenu felt weakness in the last week of April and after some time she was pronounced covid positive.
"the petitioner complained of generalized weakness on 28th April 2021, she was tested for COVID and found to be Positive"
An isolation ward was arranged for her but when she faced a problem in breathing due to low oxygen level, she was transferred to the Guru Teg Bahadur Hospital. It was also stated that the petitioner was also discharged with a diagnosis of Diabetes Mellitus II, hypertension, moderate COVID19, bilateral pneumonia and lower respiratory tract infection.
When she was in an isolation ward, she mentioned her right eye's diminished vision. The court observed according to the MRI report of her brain and orbit by Safdarjung Hospital on May 17 suggested that her right frontal bone Osteoma & diffuse frontal & parietal predominant cerebral atrophy, there was no sign of Black Fungus. However, the court proceeded with granting her interim bail till the next date of hearing considering that the MRI report suggested that there was a requirement for specialist treatment.
"In view of the fact that from the findings of the MRI report the petitioner would need specialist treatment, this Court deems it fit to grant interim bail to the petitioner till the next date of hearing," the court said.
