The Supreme Court Wednesday in the case of State Of Haryana vs Hardik Sikri and others (Jindal University Rape Case) ordered the accused to share the password of laptop as well as of icloud with the complainant. A division bench of Justice S.A. Bobde and Justice L.N. Rao clearly expressed that it is not tolerable when the victim of a gang rape is black mailed continuously.
Senior advocate Colin Gonsalves, appearing for the complainant contended before the apex court on Wednesday that the three accused -- Hardin Sikri, Karan Chhabra and Vikas Garg are still having nude photos of his client and are blackmailing her by the threat of releasing her nude photos, even after regular questioning of police and university authority the password was not shared, in response of which the Senior Advocate Shanti Bhushan, appearing for the accused contended that the complainant voluntarily sent those photos to them.
The bench told the counsel of the accused that “if you still have those photos with you give its access to the girl and if you have deleted, then it is your responsibility to make sure that they are not released.”
The counsel for the accused made sure that if any password is there than it will be shared, and were also ready to fill an undertaking in this regard.
The case was all about the incident when a girl in 2015 filed a complaint against the three students of O.P Jindal University, alleging that they were blackmailing her and raping her since 2013, in its decision the trial court sentenced imprisonment of 20 years to two of the accused and of 7 years to the remaining one, then the high court over ruled the judgment of trial court and suspended their sentence in September 2017.
Then the girl approached the apex court in search of justice.
