The Delhi High Court on Wednesday granted bail to Aam Aadmi Party (AAP) MLA of Deoli, Prashash Jarwal, in a doctor's suicide case.
While ordering the accused to file his bond with the 25,000 bond guarantee and the same money guarantee, Bench Sitsh Kumar Kait's single Bench noted that Jarwal is no longer needed for further investigation and the case will take more time.
The court also noted that the accused in this case, Anil Jarwal, who is the brother of Prashash Jarwal, had already been granted bail pending the trial court.
Prakash Jarwal was arrested by Delhi police after his name was found in a Delhi suicide doctor. Jarwal has been in custody since May 09.
The court noted that:
No 'Suction Note' and 'Diary' requests were lodged with police. Thus, there appears to be no proximity of the alleged violation link. In addition, in connection with the alleged looting of the Delhi Assembly Election elections held in February, 2020 all tank owners did not complain about the deceased's family members or other tank owners, made only by 'Dairy' and 'Suicide Act', some of which without a signature and separating manuscript. '
Advocate Rebecca M John, from Jarwal, submitted that the letter was allegedly written and the two were in two separate pens. The name of the applicant is written in a separate pen which does not sign the deceased in the second part of the execution note.
Ms John also revealed that the Delhi Jal Board had demolished nine water tanks that served the deceased and members of his family because he had been caught deliberately selling black water tanks during a stabbing.
Looking at these disputes, the government has announced that all water tanks operating in the district (Deoli, Khanpur, Sangam Vihar, Tigri) of MLA Prakash Jarwal have been pressured to pay pollution money to MLA Prakash Jarwal. The money was collected by his friend Kapil Nagar and Harish Jarwal and others.
It has also been submitted by the government that there is a Nexus of Tanker Mafias owned by MLA Prakash Jarwal with the help of his organizations Capil Nagar,
Harish Jarwal and others. They have full control over the operation of water distribution tanks in the community of Deoli and Sangam Vihar, since Petitioner was a board member of Delhi Jal.
The court found that the deceased and his family members had been installing a water tank since 2006, but no complaint was ever made regarding the robbery or abuse of the applicant or suspect.
The court also noted that:
'With regard to the suspension of the death benefits of the deceased and his family, in response to an RTI request made on 27.04.2020, it was stated on the part of the DJB that their payments could be suspended and about Rs.62 lakhs had been paid to them from January 2019 to January 2020.'
