DELHI HC SEEKS SCBA REPLY IN ASHOK ARORA’S PLEA CHALLENGING EXECUTIVE COMMITTEE’S DECISION TO SUSPEND HIM AS SECRETARY
On Friday Delhi High Court issued notice to Supreme Court Bar Association (SCBA) in Advocate Ashok Arora’s plea for quashing his suspension form the post of secretary of SCBA by resolution dated 8 May 2020.
The executive committee (EC) of SCBA on May 8, took a decision to suspend its secretary, Ashok Arora, with immediate effect and by this resolution, they also decided that the assistant secretary Rohit Panday will take over the roles and responsibilities of the secretary.
This resolution came after a message was circulated by Ashok Arora among the members of SCBA, to call an Emergent General Meeting (EGM) on 11 May’ 2020 to discuss the removal of Dushyant Dave, the president of SCBA from his post, for passing a resolution, condemning the public remarks in praise of Prime Minister Narendra Modi made by Justice Arun Mishra on 25 February’ 2020.
Ashok Arora alleged that Dave is using the office of SCBA for political purposes and called for his removal from the primary members of the Bar Association of India (BCI) as well.
SCBA issued a notice on 5 June 2020 to Arora asking reasons for initiating an ex-parte proceeding by a three-member committee for alleged imputations laid out in the notice.
After the suspension, Arora has sent a message to the members of the Bar accusing EC of intimidating him many times and alleged that Dave has bought disrepute to the Bar.
The Bar council of India in an extraordinary move stayed the resolution passed by the SCBA for suspending Arora.
The High Court Bench of Justice Mukta Gupta while hearing the plea of Arora seeking quashing of his suspension, issued notice and give a week’s time to file replication and rejoinder and listed the matter for further hearing on 6 August’ 2020.
