CYBERSECURITY AND THEIR LAW IN INDIA

Cybersecurity law is a newly emerging legal discipline. Cybersecurity plays an important role in our day to day life. Cyber laws in India prevent any crime committed using any technology. It can be done by hacking with the network, getting authorized access, or can leave a computer contaminant, leaving a virus into the program. Our world of internet is computer generated and this is known as cyberspace and the laws prevailing in this area are called cyber laws. Cyber laws deal with legal issues that are related to inter network information technology.

Traditional activities such as theft, fraud, forgery, defamation are a part of cyberspace. Here when we talk about cyberspace we should understand that this is a boundless medium. Cyberlaw is important because it involves all aspects of transactions and activities on the internet, the world wide web, and cyberspace.

Cybersecurity and cybercrime have a direct connection. Crimes that are done on the internet and computer are called cybercrime.

There are three categories of cybercrime –

  • Cybercrime against a person: Targeting a particular person using cyberspace.

Example – Cyber nuisance, stalking.

  • Cybercrimes against property: Targeting a particular property.

 Example – Hacking a computer system.

  • Cybercrime against nation: Targeting a particular country.

Example - Cyber terrorism.

In India, cyber law doesn’t have separate legal work. Cyberlaw is a combination of contracts, protection of data, intellectual property, privacy laws. As our life looks controlled with the internet and computer, there was an essential need for strong cyber law.

With the more and more use of technology and the increase in the dependency on the use of technology, so there is a need for cyber law. As said that every coin has two sides so the dependency on technology even has its pros and cons. The evolution of cyber law in India happened with the Information Technology Act, 2000 which is popularly known as the IT Act. The first cybercrime was recorded in the year 1820.

  • Objective of the Information Technology Act in India are:
  • It provides a legal transaction for all the e-transactions.
  • It gives legal recognition to keep accounting books in electronic form by bankers.
  • It protects online privacy and the stopping of cybercrime.

Why is there a need for cyber laws..?? As the present world is more into technology, the words cyber law and cybercrime have become more important. Internet and technology are there to make the lives of humans easy and also for researching. As the number of people on the internet is increasing so the need for cyber laws in India is needed. It is easy to commit cybercrime and so many of us misuse the internet as the nature of this is anonymous.

Ways we can prevent cybercrime:

There is no doubt that cyber laws in India protect from cybercrime. But as it is always said that prevention is better than cure. So the following steps could be taken to prevent cybercrime.

  • Personal information request: We all have once received a call or a mail-in which we have been asked to give our personal information which includes our CVV or mail containing an attachment. We should never respond to such emails or calls.
  • Downloading: When downloading anything, we should be sure that we are downloading it from a trustworthy source.
  • Unsolicited text messages: We all have received messages from an unknown number. We should be cautious and avoid responding to such text messages.

Conclusion:

A society that is especially dependent more and more on technology, crime based on electronic law is breaking bound to increase and because of that, the lawmakers have to go the extra mile to keep away the imposters.
