Delhi High Court has asked the prosecutors to file status reports in criminal cases in a proper manner, with all the necessary details which are important for determining the bail application filed therein, and etc.

Justice Suresh Kumar Kait has directed the prosecuting agencies to carefully follow the guidelines given by the Gujarat High Court in the case of Thakore Laxmanji v. State of Gujarat: MANU/G/J/0267/1992, in order to be ensured about that the Courts have passed the order after being fully aware of the case.

It will be compulsory for all the prosecuting agencies to file the following details in the status reports before submitting them in Delhi High Court:

  1. Crl. Appln. No.
  2. R. NO. Of Police Station
  3. Name ( s) of the accused
  4. Name (s) of the deceased
  5. Name (s) of any other injured person (s)
  6. Date, time & place of incident
  7. Date, time & place of filing FIR
  8. Distance between the scene of offence and Police Station where FIR filed.
  9. Name of the informant, whether an eye witness?
  10. Offence alleged
  11. Weapons in the hand of the accused
  12. The part played by accused and injuries caused to the respondent
  13. Who gave fatal blow(s) to the deceased?
  14. Cause of death, whether corroborated by medical evidence on the record?
  15. Which accused injured whom?

And many other points (given in the order attached with the news)

The order was delivered in a bail application submitted by Mohd. Danish, accused in the Delhi Riots case, by the Senior Advocate Salman Khurshid.

Justice Kait observed while issuing notice to SPP and granting time to submit a status report.

“This Court has come to an opinion that various status reports submitted by the prosecuting agencies most of the time, the information needed are not mentioned.”

It also stated that because of the same situation, the Gujarat High Court had passed an order that the SP responsible or any other Police Officer concerned with the supervision of the investigation of a matter as well as the public prosecutor in charge of the bail application has a duty to check proper filing of the affidavit in which all the facts important for a case should be filed before the Court.

Justice Kait said that the guidelines issued by the Gujarat High Court will be followed in Delhi High Court also.
