Sanjay Garg v Union of India
A petition was filed under Article 32 of the Constitution of India , seeking judicial interference to help improve the State of infrastructure of fire and allied emergency services in India. Article 32 of the Constitution of India confers writ jurisdiction upon the Supreme Court and to provide judicial recourse by issuance of writs if there is violation of fundamental rights.The petition submits that the the need to have safe and secure environment reagarding the same comes under the ambit of Article 21 that confers the right to life.
The petitioner relied upon a myriad amount of statistics and data to prove the current state of infrastructure of fire and allied emergency services in India. which are in condition of apathy. The state of infrastructure of fire and allied emergency services in India which falls under the Schedule 12 of the Constitution of India , is governed by the respective State Governements and Urban Local Bodies. The petition seeks directions to the authorities to adopt the Model Bill on Maintainance and Provision of Fire and Emergency Services . to remain in force till a suitable law is passed under this regard.
The petitioner primarlity focuses upon the large incidence of fire accidents that have broken out troughout the country and the inapathy of the respective State governements in implemenation and even introduction of fire safety laws. Reference in this regard is made to the recent fire in a Surat Coaching Centre that resulted in mass deaths of students. Sprodic incidents of mass fires particularly in pubs and restaurnants are also a huge cause for concern. The lack of training and proper material to firefighters itself results in a whole detrimental mandate to combat the threat of breaking out of fires itself
A Bench of Justices comprisintg Arun Mishra and Ravindra Bhat issued notice in the petition filed by the petitioner Sanjay Garg and asked the respondent the Union of India to reply within a time frame of six weeks.
