A Ntional level survey was taken by Mr.Suresh Rathi, the Registrar of Supreme Court, regarding offences against children under the POSCO Act (The Protection of Children from Sexual Offences). Rathi gave a report of relevant figures which shows different type of offences under POSCO. In his report to the court,rounded percentage figure was given of the offences some of them were-
Assault 31%
Penetrative sexual assault under section 4 is 32.1%
Sexual assault 3%
Sexual harassment 8%
Use of children for pornography 1%
Abatement 2 %
Gender wise percentage of victimization under POSCO FIR for girl 80% boys 60% others 14%.
The report also stated that the the children of age 13 to 16 are harassed the most by 60%, 15 to 18 years 22%, 6 to 12 years by 13%, 2 to 6 by 4%. During the survey it was found that the around 56% of the time the accused was some known person of the victim and 27% of the times it's the friend or neighbours and 9% are strangers. Usually time taken for completion is on an average 20% for investigation.
It was disheartening to find that the percentage of cases in which support to the aggrived child is provided is just 4% and 96% of the time the support is not provided to the aggrieved also 99% of the time interim compensation as well as final compensation is also not provided. The Supreme Court observed that from the report of Suresh Rathi, it appears that one major reason for the inability of the stakeholders to meet the deadline stipulated under the act, is lack of awareness and lack of dedication in completing investigation within the time frame stipulated the inadequacy of the number of courts have also resulted in cases remaining pending beyond the period mandated for completion for trial under the Act.
The Court asked all the State governments as well as the Union of India to take all the necessary steps to ensure that all stages of investigation as well as trial are contemplated under the act within the time stipulated and make officers aware about the POSCO Act so that chargesheets are filed within mandatory period and trials are completed within the time and investigations carried properly.
