The dilemma created after the last week’s unprecedented mayhem at higher judiciary regarding the assignment of cases has been put aside for the time being when Chief Justice Deepak Mishra himself decided to preside the Supreme Court bench consisting of 3 judges to decide upon the petitions seeking detailed probe into the suspicious circumstances leading to the death of former CBI Judge BH Loya. It is noteworthy that earlier the bench headed by Justice Arun Mishra was hearing the matter, but a subsequent recusal took place owing to the infamous 4 judge public conference last week in which Justice Loya’s case was also raised as a point of contention. They further alleged CJI to be biased arbitrary while assigning important cases.
Justice Arun Mishra took on to express his disappointment over the incident and called it as an act of denigrating the judiciary. He also alleged that the allegations of being called as ‘bench of preference’ had tainted his reputation. Subsequently the matter assigned to another bench headed by Chief Justice himself which is up for hearing on Monday.
The case deals with the alleged suspicion of murder of CBI Judge BH Loya who was then presiding over Sohrabuddin encounter case in which political leader was accused to be the complicit. The issue came into the lime light after 3 years when a news magazine published a report alleging the death of the Justice to be a murder.
