The Hon’ble Supreme Court of India had dismissed the review petition filed in the name of V K Sasikala, AMMK President which was being heard in chamber on April 23, 2020. The matter was had and the apex court had dismissed the review petition filed which was the decision of Politician TTV Dinakaran who was denied of his current party symbol ‘Pressure Cooker’.
The appellant to the abovementioned petition had claimed under section 29A of Representation of the People Act for the symbol and the court held it cannot be so done as the appellant and his group had not followed the compliances issued by the Election Commission of India. The court held that, “…the EC on due and proper satisfaction that the candidates named in the document marked with the letter 'X' want to contest the election under any one common symbol, will make all endeavour to ensure that in the forthcoming elections i.e. 40 Parliamentary Constituencies (39 in Tamil Nadu and 1 in Puducherry) and 19 Assembly Constituencies, the aforesaid candidates be allotted any one particular free symbol.”
The apex court also held that the EC has the discretion as the recognition of the group as political party registered or not. The appellant had also challenged the verdict given by the Delhi High Court on AIADMK’s symbol led by TN Chief Minister E K Palaniswami on the aspect of limited use of AMMK’s symbol. The court had ultimately rejected the grevience filed by the appellant against the order of EC assigning ‘AIADMK’ and ‘two-leaves’ symbol to the Palaniswami-led party.
