SC Dismisses Plea Seeking Uniform Welfare Scheme for Lawyers In Distress Due To Lockdown
On Friday A petition has been filled in Supreme court by Filed by Advocate Abhinav Ramkrishna, seeking directions to Government and Bar councils to formulate a uniform national level Welfare scheme to provide financial assistance to the needy lawyers who had been affected by Nationwide lockdown due to COVID 19 outbreak. COVID -19 a pandemic outbreak affected businesses all across the globe and in every profession, specifically in the marketing and sales. Lawyers also suffer economic loss from Nationwide Lockdown.
The plea had stated that “the Government, Bar Council and the State Bar Councils cannot be expected to be in a state of deep slumber or be insensitive towards the economic and mental hardship faced by lawyers, except few upon who have achieved a milestone by dint of their hard work and acumen.”
The Writ Petition also notes that the financial scheme announced by India's bar council to provide lawyers with financial assistance had no meaning, since the sum disbursed had been kept unclear. It was also argued that "Government can not be a mute spectator of the hardships faced by lawyers during the lockdown" as government is primarily responsible for the effective establishment of the judiciary in this country. Furthermore, the plea, which Senior Advocate Jayant Sud argues, that lawyers across the nation paid welfare amounts on filing the vakalatnama.
A three-judge bench comprising Justice Ashok Bhushan, Justice Sanjay Kishan Kaul and Justice BR Gavai heard the matter through video conferencing, held that the petition could not be filed under Article 32 as they're in no breach of fundamental right is there. Accordingly , the petition under Article 32 was disposed of.
