Harish Salve advocates tribunals for private defamation to fast-track cases.
When compared to the English Law, Harish Salve stated cases to be solved within six months. The Civil Defamation cases could be dealt smoothly, Senior Advocate Harish Salve directed setting up of private tribunals. “I have suggested to the government that you must have tribunals for private defamation. Otherwise these cases just go on and on” Harish Salve, the Senior Advocate said. Mr. Harish Salve was also appointed at the Queen’s Counsel recently at England and Wales which is equivalent to Senior Advocate in India, moreover spoke on “Insulating our Judiciary from social media diatribes”, in a webinar organised by CAN Foundation. Then, he compared the time period of the cases to be solved which is six months in the English Law. Moreover, he when came up with the issue criticism of the Judges, he explicitly said that “you criticise judgment and not the judge”. Salve also came up with the allegations of Tushar Mehta, the Solicitor General who dropped comments on the Senior Advocates on the conditions of the Migrants. Tushar asked out about the PIL filed on Thursday, and which stressed on the problems faced by the migrants. Majorly, the comments were against some of the Senior Advocates and the Congress leader Kapil Sibal. “A lot of people, who are not elected, feel they can impose their will on the government through Courts”. Salve said. “One can criticise on whether the court should have intervened or not in the case, but to say that the court is scared of the government is wrong”. Moreover, the most recent and big stories which said about the verdict in Kashmir, related to the internet speed, Salve said “it is not that the Supreme Court has not stood with the people of Kashmir…. One has to have faith in the Court.” When advocate, Avishkar Singhvi asked whether judges should exercise “self-restraint” criticising the sitting Judges? Salve responded “there cannot be a cooling off period after retirement but they are all part of the same team”
