The Supreme Court on Friday denied to recall the order passed on April 13 which excused the suo moto writ appeal taken by the Court on a letter request sent by TMC MP Mahua Moitra. A bench including Justices Ashok Bhushan, S K Kaul and M R Shah discarded the new interlocutory application recorded by Moitra in the suo moto case taken by the Court on the migrant workers issue. Justice S K Kaul told the following to Senior Advocate Jaideep Gupta, who was representing the case of the MP from Krishnanagar, West Bengal.
"She is a respectable Member of Parliament. If we allow this, it will become a chaotic situation. We have assistance from the Union and States."
The Court also observed that since the court was already considering the same kind of issue in the Suo Moto case, there arose no requirement to recall the order. The bench stated as under:
"We do not find any good ground to recall the order since this Court has already entertained SMW (C) No. 6/2020 where all the issues are under consideration."
The bench anyway permitted the Senior Advocate to make entries, whereupon he set forth certain recommendations for smoothing out migrant transportation and enrollments. Subsequent to hearing the Center, a few States and scarcely any interveners, the Court held requests in the issue for June 9. In the review application, Moitra likewise looked for the constitution of a court observed autonomous board to evaluate the emergency and suggest reasonable cures, expressing that the Union Government had "completely fizzled" to deal with the circumstance.
On April 3, the Court had taken suo moto notice of a letter composed by her in regards to the predicament of abandoned vagrant laborers.
