The Central Government has released a notification for the establishment of a Central Administrative Tribunal Bench in Jammu. As notified in the notification in the Official Gazette, the bench established newly shall have and exercise the jurisdiction over the Union territory of Jammu and Kashmir and Union territory of Ladakh. The Honorable Supreme Court on May 22, 2020, had issued a notice while hearing a plea for setting up of a permanent bench of Central Administrative Tribunal for hearing service matters in the Union Territory of Jammu and Kashmir. The petitioners had filed a petition in order to quash the notification of the central government released on 29 April 2020 which had conferred the jurisdiction to the Central Administrative Tribunal, Chandigarh Bench in order to hear the service matters arising in the Union Territory of Jammu and Kashmir. The petitioner contended that the notification released by the central government on 29 April 2020 was unconstitutional and hence, it violates the principles of the constitution. While restoring the jurisdiction of Central Administrative Tribunal, Chandigarh Bench pre-April 29, 2020, now the central government has released a notification for setting up of new Central Administrative Tribunal for Jammu, within the time period as notified in the plea.
The Central Administrative Tribunal has been established in order to adjudicate the matters and disputes relating to recruitment along with the conditions of service of persons who are appointed to the public services and the posts relating to the affairs of the Union or any other local authorities that come within the jurisdiction of India or under the control of the Government of India and any such related matter. This was done in consonance with the amendment to the constitution by insertion of Article 323A. The Indian Constitution under Part XIV-A provides for the tribunals. This provision was inserted by the 42nd Amendment Act, 1976.
