Lucknow bench of Allahabad High court on Saturday 04/06/20 decided to sail on floating boat by adopting video conferencing method to conduct hearings due to burgeon of contagion in the city.
The Lucknow court immediately after witnessing the spike of virus in the city unilaterally stated ".. as communicated by a committee constituted to address the issues relating to represent to reopening of courts in Lucknow and looking into the recent spike in number of corona-virus cases and containment zones in Lucknow, hearing of cases shall be conducted only through video-conferencing from July 6 onwards " said the bench.
Oudh Bar Association has, however, unanimously opposed the decision of court by stating it was not consensual. The Bar Association rather insisted the court to conduct hearing in the newly constructed high court building in Gomtinagar where all the guidelines in order to contain covid19 can be adhered to by advocates and clerks. Bar also stated that the court rooms are spacious enough to accommodate 20 advocates excluding judge and court staffs by adhering to the guidelines like physical distancing.
OBA condemned the move opted by HC by stating " ..there is no logic to physically close to high court and run it only through video conferencing which is not feasible at all, while other government offices, commercial establishments are open".
Alike senior advocate of Madhya Pradesh, B L Pavecha who wrote a letter addressing chief justice of Madhya Pradesh urging to initiate the regular functioning of court as it is causing unbearable penury to several advocates and clerks which is indirectly harming public and the similar was stated by Oudh Bar Association president HGS Parihar and other officer bearers to Lucknow bench.
The resolution was passed in a meeting in which president expressed dismay of the decision unilaterally who is intending to address the innumerable or boundless loss.
