The High Court of Telangana observed that, it's the duty of the State to ensure that in the name of "tradition" camels must not be slaughtered.
A two-judge bench comprising Chief Justice Raghavendra Singh Chauhan and Justice B. Vijaysen Reddy observed the lack of strictness of authorities in controlling illegal transport and butchering of camels. The court said that there is a " tradition" of consuming camel meat in the State during the of Bakrid, which is around the corner. It was remarked by the bench that, “The report submitted by the government does not state any concrete steps taken in the last five years”.
The report submitted by special government pleader Sanjiv Kumar stated that eight camels have been rescued earlier. On that, it was questioned by Chief Justice Chauhan that, from whom the animals were rescued what action had been taken on those persons. The bench observes, “The report does not even say if those camels are put back to right place”. Petitioner counsel called attention to however there were numerous incidents reported on rescue of camels transported illegally the State report said only eight camels were rescued. The Chief Justice said, “How many unlicensed meat shops are running in city nobody knows. The authorities concerned should wake up to this menace”.
The bench on Friday directed the UOI and the state to publicize through electronic and print media, the fact that the transportation and slaughtering of camels is an illegal activity.
The Division Bench was hearing a PIL filed by Dr.Shashikala Kopanati challenging the act of the GHMC and State government is not taking any action o prevent the illegal transport of camels into the State of Telangana and slaughtering them contrary to the provisions of Prevention of Cruelty to Animals Act, 1960 and other laws including Rajasthan Camel Prohibition of Slaughter and Regulation of Temporary Migration or Export Act, 2015.
The bench, noting the cruelty towards animals is prohibited under the Act of 1960, expressed that since the transportation of camels out of Rajasthan is prohibited, the State has to ensure that camels are not brought into the State surreptitiously.
It was informed by Special Government Pleader to the court that teams to check the illegal camel transport and slaughter Police Department had formed teams. Correspondingly, to take action against those who are violating the laws, and to prevent the illegal killing of camels, the bench required the state to inspect the licensed and unlicensed slaughterhouses in the Twin Cities of Hyderabad & Secunderabad and the Ranga Reddy District. And it was directed by the bench to submit the report on July 29 detailing the actions taken.
Furthermore, the case is regarding committing cruelty towards a particular animal, as it was contradicting the provisions and rules under Prevention of Cruelty to Animals Act, 1960, the respondents are duty-bound to protect and promote the interests of the camel.
