The Delhi high court dictated an order directing removal of construction and concrete to save and restore the health of a 3 centuries-old banyan (badh ) tree situated in Chandni Chowk as a measured step. The court also directed the tree officer, Government of Delhi, to immediately recommend required measures that need to be taken to restore the health and condition of the banyan tree.
A petition has been filed in the Delhi high court for the same. Petitioner had approached the court praying for the protection and restoration of 300 years - old banyan (badh )tree from illegal construction by the builder.
The court observed that the grand old tree has viewed the unfolding of history in Delhi and has now been ruthlessly cut and disfigured by the real state builders without appreciating vital heritage.
The court remarked on the impairment of the tree,
‘So first, the builder extensively cuts the decades-old branches, then chops-off its intricate labyrinthian prop-roots and then digs the earth about 12-14 feet deep – all around the tree, for erecting concrete walls/support base for a steel and iron superstructure. In the process the subterranean roots have been cut, depriving the tree of the essential sources of sustenance from the earth. Its stability has been shaken. It has been ‘cabined, cribbed, confined’, in a constricted concrete space. Indeed, the photos show that the tree has already been wrapped in dark plastic sheet, like an ominous black shroud as if its end is nigh.’
Further tree officer informs the court that the tree can be saved and restored to some good health. The bench directed the Tree Officer to promptly imitate all requisite measures to save the tree and endeavor to nurture it to health.
Court notably ordered that census of trees in Chandni Chowk be prepared by north Delhi municipal corporation and also directed SHO of the area shall render all assistance as may be requisite, for all the aforesaid purpose.
