Writ petition was filed by Shiv Shankar which was on 30.7.2020 and bench by honorable chief justice Mr Abhay Oka and Justice Ashok S Kinagi which was dismissed on Monday
Petitioner was represented by Rodda Veer Shetty and respondents were represented by Vijaykumar A Patil
It was filed under article 226 B and 227 of the Indian Constitution praying to issue writ of mandamus and question that how the state allowed the accused or the Convict to act in the film
Counsel of the petitioner argued that Sanjay Datt (accused 3) was convicted for the bombings in Mumbai which is upheld by the Supreme Court of India and the whole state that is Karnataka does not want him to act in the film kGF-2 and also oppose that respondent 2 that is Hombale films was helping
Court suggested that Sanjay Datt was not disqualified by acting in the film and there is no such law that prevents a person from acting if he is a Convict.
The Honorable Court by stating "No legality is pointed out in the present case. There is absolutely no merit in the petition and the same is accordingly dismissed."
At the outset of the matter, there is no opposition by the public due to acting or for casting Sanjay Datt in the film and he is not disqualified by the law
Although Sanjay Datt had a questionable career in his life, he remained clean sheet for most of its part. The personal cases should not affect the professional life.
Sanjay Datt was sentenced having illegal possession of 56 rifle that had been used in the terror act of 1993. He was released early due to his good conduct in the jail on 25th February 2016, 8 months and 16 days before is five year sentence.
