Navroz Seervai Slams Bar Council of Maharashtra and Goa for Supporting Prashant Bhushan Contempt of Court Judgement

Senior Advocate Navroz Seervai has convicted the Bar Council of Maharashtra and Goa’s support of the Supreme Court stated in which it stated Prashant Bhushan guilty of contempt of court for two tweets against Chief Justice of India SA Bobde and Supreme Court as being an intrusion of power and a subservient, self-serving attempt to curry favour with the Chief Justice of India. Seervai in his statement has stated that unsupported unanimous resolution looking for to represent the interest of one lakh seventy-five thousand lawyers is an intrusion of power that must be strongly condemned by lawyers and Bar Council in Maharashtra and Goa. (Yesterday the Bar Council of Maharashtra and Goa passed a resolution condemning effort to pressurize the judges of the Supreme Court by issuing statements against courts judgement.)

Navroz Seervai stated that the State Bar Association has no right to speak on behalf of and sense to represent one lakh seventy-five thousand advocates as the capture of power he stated that the resolution speaks expressively to the reckless manner in which the Bar Council misconducts itself. Knowingly, Seervai has already spoken his views against the Supreme Courts Judgement in the Contempt Case. He said in his statement that the judgement is a hammering on free speech and expression in the name of care the dignity and magnificence of court in the eyes of the public. The judgement is mistaken both in its reasoning and its analysis and explanation of the contempt jurisdiction. He said that the decision seemed to be an intended assault on the one section of civil society which is familiar with what happens in court and the behaviour of judges in and out of court namely members of the legal profession and that it will have a chilling effect on the speech and that appears to be it's determined but it is also projected to send out a strong message to the legal profession by making an example of Prashant Bhushan for daring to exercise his fundamental right to freedom of speech, under article 19(1)(a).

The additional calls for the strongest censure for the same from lawyers as well as the Maharashtra and Goa Bar Association. Firmly placing on record his disapproval of the resolution. Moreover, Seervai expresses his disapproval of lawyers in Maharashtra and Goa he says the council has no right to do so in the manner. The full house resolution said to be passed on 19th August 2020 does not speak for all members of the bar and not for me. He has stated that the full house resolution is a submissive, self-centred attempt by the bar council to curry favour with the Chief Justice of India to whom it has been forwarded.

Several lawyers in India have expressed their disappointment at the supreme court decision, and issued a public statement and held protests expressing unity with Prashant Bhushan, over two thousand lawyers including senior advocates have permitted the statement of support for Prashant Bhushan.

Conclusion

The Senior Advocate and noted jurist Navroz H. Seervai has taken strong exception to the full house resolution of bar council of Maharashtra and Goa in support of the Supreme Court decision holding advocate Prashant Bhushan guilty of contempt of Court for two tweets he put on Chief Justice of India and the Supreme Court. He is against the verdict passed by the Supreme Court as well as the resolution which was signed by One Lakh Seventy-Five Thousand Practicing Advocates which stand by the Supreme Court’s judgement. He said that many lawyers in the country have expressed disappointment and around two thousand advocates are also standing with Prashant Bhushan.
