In a phased manner from September 28, the District and Trial Court in the State would reopen. Modified Standard Operating Orders were issued for the district/trial courts to follow on reopening to prevent the spread of Covid-19 by the Karnataka High Court on Saturday.
Fifty-five taluka Courts as per the revised Standard Operating Procedure will be opened from September 28. With effect from 5th October 2020 all the courts in thirteen districts viz., Haveri, Chitradurga, Davanagere, Chikkaballapura, Bidar, Raichur, Ramanagara, Gadag, Udupi, Koppal, Yadgir, KodaguMadikeri, and Chamarajanagar will reopen. From October 12, 2020, all the Courts from the remaining district will be reopened.
There will be modifications in all the Courtrooms as for the recording of evidence both accused dock and witness box will be covered. In the morning session of every working day, it would be open for the Courts to physically record evidence for a maximum of five witnesses. In the morning and afternoon sessions, every Court shall list fifteen cases each.
While scheduling the cases, priorities shall be given to cases of hearing of final oral arguments, hearing of interlocutory applications, and recording of evidence in part-heard of criminal and civil cases. The Court complexes will continue to prohibit the entry of litigants.
Entry would be allowed to the witnesses and the accused (on bail), upon production of a negative report of rapid antigen test on the same date, entry pass or witness summons will be allowed for entry in the Court.
In the Court Hall including Advocates and the Court Staff should not exceed 20 persons. The judicial officer would stop hearing if the said limit exceeds. At the designated places in the Court Complexes, the parking of Advocates’ vehicles will be allowed.
Only self-driven vehicles of the advocates will be allowed on the production of photo-identity which would be issued by the recognized Bar Associations. Premises of all Bar Association will be open between 10.30 am and 4.00 pm, half of the chairs on the premises will be removed before opening.
The canteen on the Court premises will remain closed and the entry of photocopy machine operators, typists, and the notary will not be permitted. Chief Justice in case of emergency will take decisions regarding permitting closure of courts for sanitization and suspension of hearings.
