Brus is a community settled in the districts of Tripura, Mizoram, and southern Assam. The majority of the Brus in Assam and Tripura are Hindus while the others converted to Christianity. During the late 90s, there was a huge ethnic clash between the two ethnic groups due to the demanding of Brus to include indigenous people in Mizoram's electoral rolls. The clash that resulted was armed leading to many killings and 40,000 Brus migrating to neighboring Tripura. After the incident, through an accord between the central government, state government, and the Brus, they offered a settlement for 30,000 to 35000 Brus in Tripura. If the agreement is implemented it would give the choice to the people to settle in Tripura or Mizoram
A plea was filed in The Tripura High Court clubbing various issues and asking for the need for implementation of said accord to allow the resettlement of the people. The bench consisting of CJ Akil Kureshi and Justice Talpatra, in September, made an observation that the matter involves a question of a socio-political nature and hence needs political and administrative involvement rather than a court’s adjudication.
The claim of the petitioner before the court was to advocate the cause of Brus for proper resettlement. The petition involved several questions but the main prayer was to reconcile the government to make arrangements for the resettlement of displaced Brus. On 12th January 2021, the court refused to entertain the matter and held that this is a case which involves extremely sensitive and intense socio-economic and political question which the court cannot interfere with. And the court must allow the administration and the legislature to take appropriate steps. The court was cautious enough to not indulge in political and administrative matters for the best of the reasons mentioned in the order below.
