The Supreme Court, in response to a writ petition filed by Judges appointed on an ad-hoc basis, granted retirement benefits to the petitioners. The Bench acting as an appellate authority to the Madras High Court, where the petition was originally filed, declared that the petitioners, as well as judges occupying similar posts, temporary or permanent, were entitled to retirement benefits, including pension and encashment of paid leaves for a max period of 240 days. The Court also added that the benefits must be paid to the Judges within a period of two months, post which, the beneficiaries would be entitled to simple interest against the monetary value at the rate of 7% per annum.
The Apex Court clarified in its judgement that ad-hoc posts, which are usually predicted for five years, and almost always exceed that period, are not contractual. Prior petition to the Madras High Courts was dismissed as the HC declared the opposite. The SC bench comprising of Justice AK Sikri and Justice Ashok Bhushan delivered the verdict.
