The Allahabad HC bench comprising of Justice Devendra Kumar Upadhyaya and Justice Manish Kumar gave the order directing the Government of Uttar Pradesh and the concerned Hospital authorities to carry out cost-free medical treatment to an indigent lady, suffering from breast cancer, who is not able to afford proper treatment due to lack of money after her son, Sauhard Lakhanpal drafted a petition seeking financial help for his mother suffering from Infiltrating Ductal Carcinoma, a form of breast cancer, in order to undergo her treatment.
According to the petitioner, uploading to the expensive cost involved in the treatment and the family income being so less for a basic livelihood it was mentioned that his family was facing a huge risk of the medical treatment.
The High Court vide appointed Advocate, Murli Manohar Srivastava in the matter for assisting the court.
The approximate cost of the mentioned by the King George's Medical University, Lucknow was Rs.1,50,000. The petitioner was granted Rs.75,000 from the CM's Discretionary Funds as a grant on July 2020, due to a shortage of funds, the petitioner was not able to go on with the treatment.
The counsel that appeared on behalf of the State Government informed the Court that the govt has made provisions for providing cost-free treatment to cancer patients. The slab includes Below poverty line cardholders, people holding up to 3.25 acres of land or whose income is less than Rs.35,000 per anum.
He relied on the 2013 Rules which provide that State Medical Colleges and institutions will provide free of charge medical facility for treatment of incurable diseases and in case any further facility is required for treatment, the treating Medical College is required to refer the patient for treatment to other Medical Colleges.
In view of the above, the Court issued certain directions, and now the case is listed on 24th March 2021. The Court also asked the Chief Medical Superintendent of Hospitals at KGMU to provide a report on the next hearing mentioning details of the steps taken for the treatment.
