The High Court of Kerala directed the state police to take action against a woman who filed a falsely accused a man of raping her after having consensual sex with him.
The complaint by the 44-year-old woman was filed in the first week of September in the district of Thiruvananthapuram. The woman who worked as a home nurse was asked to quarantine by the accused health official. She underwent a coronavirus antigen test, the results of which were negative. She was asked to collect the report from the man's flat. According to the complaint that she had filed, the man sexually assaulted her at his house and tied her up, allowing her to leave the next day.
The falsely accused junior health official who by that time spent 77 days in custody was granted bail last year in November after the woman filed an affidavit stating that the sexual intercourse between her and the man was done with mutual consent. The High Court had then ordered the State Police Chief to hold an inquiry against the woman. After the police inquiry report got submitted in the court on February 22, 2021, the High Court ruled that the complaint filed by the woman was a false rape accusation and directed police to take legal action against the woman under Section 182 of IPC, 1860 (spreading false information with the intent to cause a public servant to use his legal power to cause an injury to another person).
The court stated that the criminal case was sensationalized at the time of the FIR itself. It was covered thoroughly by the media which negatively impacted the morale of all healthcare workers of the state. Exclaiming that the damage caused by this incident to the healthcare workers was irreparable, the court expressed hope that the media houses would equally publicize the inquiry report as well.
