The Jammu & Kashmir HC on February 16th of 2021, Tuesday directed the State Government that no further construction should be allowed within the marked territory and area of Gulmarg tourist resort.
The Division Bench of Justice Vinod Chatterji Koul and Justice Ali Mohammad Magrey directed thus while hearing a petition seeking the restoration of prestige and pristine glory of Gulmarg, a world-renowned tourist resort.
It was a respondent named Mohammad Rafiq Zargar who filed the PIL challenging the State of Jammu & Kashmir and others on the subject matter of the preservation of glory and prestige in the region of Gulmarg.
It may be noted that for about 8 years long, the Jammu & Kashmir HC has been monitoring and conducting the research statistics on the instant petition and ensuring that the divine glory and the prestige of the tourist spot, Gulmarg remain preserved.
The High Court has passed a twist and turn of orders and directions focusing and aiming at preserving the glory and prestige of Gulmarg.
However, on the research and examination of directions passed from time to time as also status reports filed by the petitioners and respondents, the Court found it important to further pass directions as under:
The Chairman of the Pollution Control Board shall make sure that all the resorts and hotels in Gulmarg have constructed proper sewerage and drainage facilities available.
The Chief Conservator of Forests shall strictly make sure that trees are not being felled in the reserved areas of Gulmarg.
The chief secretary of J&K has been appointed for the preservation of the glory and prestige of the region after the challenge of respondents filed the petitions.
Particularly in the said meeting, it was directed to take a fresh procedure for formulation of Master Plan. A number of Committees were formulated including one to consider increasing and renewal of leases were in respect of live lease cases and expired lease cases.
