A 33 year old man, Imtiaz Patel, is facing legal proceedings initiating a divorce against his wife by resorting ti triple talaq. According to the man's wife, she received a message in Whatsapp with the text- 'Talak dera hu main tko talak talak talak', which roughly translates to 'I am divorcing you, talaq talaq talaq'. On 30 November 2018, Imtiaz Patel was charged under the Muslim Women (Protection of Marriage) Act, the first case under the above act in the state of Maharashtra, as reported by Indian Express.
Imtiaz Patel, his mother and his sister were charged under section 498A (Cruelty to women), 506(Criminal intimidation) and 34(Common Intent) of the Indian Penal Code along with provisions of the Muslim Women (Protection of Marriage) Act. On 5th August, the Thane sessions court granted anticipatory bail to the accused's mother and sister, but rejected the plea of accused stating that the seriousness of the case made the court decide against granting anticipatory bail.
Aamir Shaikh, the accused's advocate, informed the court that Imtiaz had pronounced triple talaq in frustration and anger, but was ready to take forward the matter through mediation to ensure that his six month old is provided for.
The Bombay High Court bench of Justice Revathi Mohite Dere granted anticipatory bail for Imtiaz Patel and adjourned the hearing for 28th August 2019.
