NOTE ON NIRBHAY CASE CONVICTS
One of the student was brutally gang raped in Delhi on the intervening night of 16 December inside a moving bus. She died in Singapore at Elizabeth Hospital on 29 December 2012.The four convicts of Nirbhaya gang rape will be punished. They will be hanged on January 22 at 7 am in Tihar jail before the order of judge. A video conference call conducted with them who are lodged in Tihar. The Judge conducted the video call. The verdict victim’s mother faith of women in the judiciary to be restored. It took seven year to change this whole system and it must ensure that rapist would be hanged under six months.
The verdict acted as deterrent which against the women. BJP said that decision for this case would strengthen societies faith in the judiciary and people. I can understand that for juvenile convicted had sent to the reformation home foer serving three year term. But those convicts who are above age of 18 years they will be hanged. Deepak Misra a special bench of chief justice of India and justices R.Banumthi and Ashok Bhushan they rejected the convicts ’plea and they said to relook into the case on the ground that the convicts not represented by the lawyers properly during Trial courthat convicts cannot t .
On Monday, justice Bhushan, who spoke in his Judgement and said that during review petition the convict cannot reargue in the entire case and if judicial fallibility and miscarriage was there in that case they could only be entertained.
A review petition filed by convicts and it is said by advocate A.P. Singh, for Sharma and Gupta, they have argued that death penalty was like a “cold blooded killing”. Ram singh, who is another accused who died in Jail and a juvenile who released from the reformation home after three year of serving as per the juvenile justice Act. The case led to the amendment for detah penalty to make rape punishable and now the rape definition was expanded to include it is not just penetrative sex also oral sex and insertion of any object or any other thing into a woman’s vagina,anus or urethra.
In my opinion the punishment for rape is death, rape is such a brutal crime and the accused should be punished with death and this can be a good lesion for societies and rapist they will think hundred of times before committing a rape.
