PMLA 2002 U/S 45 which is dealing with bail for accused.The Supreme Court Of India bench recently declares unconstitutional of section 45(1) of PMLA 2002.This particular section of PMLA is certainly violates the constitution Article 14 & 21 and it is against the rights of the accused.The bench strongly rejected "Twin Condition" of the act and remand back all the cases to the respective courts.Directed the concerned courts hear the bail petition on merit grounds.As a result of this ruling many accused will get bail.
